AGENCY TERMS AND CONDITIONS

Collection Agency Name (“Agency”)  is a Collection Agency and is attempting to collect a debt.  Agency is providing you with the option to eliminate the debt that Agency is attempting to collect from you (the “Offer”).  The Offer specifies the name of the original creditor and the outstanding amount of the debt (the “Debt”).  By accepting the Offer, you are agreeing to subscribe to a CIRQUL Account and make recurring subscription payments to CIRQUL (each a “Subscription Payment”) for the amount and length of time specified in the Offer (the “Agreement Term”).  After you have made Subscription Payments to CIRQUL for the full length of the Agreement Term, Agency agrees to eliminate your entire Debt.  

As used herein, The words “your bank” mean the bank, securities firm, or other financial institution that holds your account and/or issued your credit or debit card.  

Payment Authorization (Automatic Payments). 

To make your subscription payments for your CIRQUL Account, including automatic payments, you must designate a valid major credit card or debit card (collectively “Payment Method”). By subscribing to your CIRQUL Account, you authorize CIRQUL Ventures, Inc. (“we”, “us”, “our” “CIRQUL”) or our agent to initiate an automated charge to your Payment Method, in your name, payable to us or to our agent, in the amount of the Subscription Payment, on the date(s) specified in the Offer (“Billing Date”) of the month(s) of payment according to the recurring schedule that you have affirmatively elected to enroll in for your CIRQUL Account. Your Subscription Payment must be payable in U.S. dollars. By paying using your designated Payment Method, you agree that: (a) you have read, understand and agree to these Agency Terms and Conditions, and that this agreement constitutes a “writing signed by you” under any applicable law or regulation; (b) you consent to the electronic delivery of the disclosures contained in these Terms and Conditions; (c) you authorize Agency and CIRQUL to make any inquiries or take any other action necessary to validate any dispute involving your Subscription Payment, which may include engaging with third-party account validation providers to validate your Payment Method or verifying the information you provide against third party databases; (d) you authorize CIRQUL to initiate one or more charges for the specified Subscription Payment to your Payment Method; (e) you authorize the financial institution that holds your Payment Method to deduct such Subscription Payments, namely debiting your debit card, and/or charging your credit card; and (f) you authorize CIRQUL to provide Agency with your Subscription Payment history for the purpose of Agency eliminating the specified Debt.

You also understand and agree by subscribing to CIRQUL for a CIRQUL Account, you will agree to be bound by and adhere to CIRQUL’s Terms of Use for their products and services.

Payments and Payment Changes.

You are agreeing to make automatic, recurring Subscription Payments for your CIRQUL ACCOUNT.  Before each Billing Date arrives, you must ensure that you have sufficient funds or credit available in your bank to cover the Subscription Payment. You may change your Payment Method in your CIRQUL Account under PROFILE then PAYMENT METHOD.  

For each Subscription Payment, your bank may assess customary charges, if any. Your bank may also assess its customary charge for each overdraft. If any Subscription Payment is not honored by your bank, CIRQUL has the right to suspend or cancel your CIRQUL Account, and Agency may cancel the remainder of this Agreement.  

With limited exceptions, CIRQUL will endeavor for your Subscription Payment to be processed within 48 hours of the due date. 

Current Information. 

It is your responsibility to make sure that your Payment Method information and contact information are current at all times during the term of this Agreement.

Cancelling Your CIRQUL Account.

You have the ability to cancel your CIRQUL Account, and the associated Subscription Payment, at any time.  It is important to remember that cancelling your CIRQUL Account before the end of your Agreement Term will void this Agreement and you will still owe the remaining amount due on the Debt. 

Debt Elimination.

For each recurring Subscription Payment received by CIRQUL, Agency agrees to eliminate an equal portion of the Debt owed.  After CIRQUL has received timely Subscription Payments from you for the full Agreement Term, Agency will eliminate the any and all remaining amount of the Debt.  

Customer Service

Subscription Payments that CIRQUL processes using your Payment Method, will be identified as “CIRQUL VENTURES INC.” (or similar identifier) on the statement issued by your bank or other financial institution holding your account. All questions relating to Subscription Payments should be initially directed to CIRQUL. You may contact CIRQUL via email at support@cirqul.com.  You may also view your Subscription Payment history in your CIRQUL Account under PROFILE then SUBSCRIPTION HISTORY.

Improper Payments

Federal law may limit your liability for any fraudulent, erroneous unauthorized transaction from your bank account based on how quickly you report it to your financial institution. As a general rule, you should report any fraudulent, erroneous or unauthorized transactions to your bank within 60 days after the questionable transaction FIRST appeared on your account statement. You should contact your bank for more information about the policies and procedures that apply to your account and any unauthorized transactions, including any limits on your liability. CIRQUL, nor Agency, will not be liable to you in the following instances:

  • If, through no fault of ours, your account does not contain enough money to complete the transaction;

  • If the funds in your account are subject to legal process or other encumbrance restricting the transaction; or

  • If circumstances beyond our control (such as fire or flood) prevent the transaction, despite reasonable precautions that we have taken

Disclosure of Payment Information to Third-Parties

To protect your privacy, Agency, nor CIRQUL, will not disclose any information about your Subscription Payment transactions to any person, except as follows:

  • as necessary to complete transactions, including without limitation to validate any account with a third party account verification provider, to verify the account prior to completion of certain web-based transactions;

  • to validate or verify the existence and condition any dispute involving payment, including with a third party, such as a financial institution or credit bureau (or, for Massachusetts residents, a consumer reporting agency as defined in chapter 93 of the Massachusetts General Laws);

  • to comply with government agency or court orders;

  • to Agency and CIRQUL employees, auditors, service providers, attorneys, or collection agents in the course of their duties;

  • to persons authorized by law in the course of their official duties; or

  • if you give your written permission.

Prior Agreements and Assignments

These Terms and Conditions terminate and take the place of all prior agreements you may have with Agency relating to any payment transactions. Agency has the right to assign these Terms and Conditions to a subsidiary or affiliate company at any time.

  • Note for Massachusetts Residents:
    GENERAL DISCLOSURE STATEMENT: Any documentation provided to you which indicates that an electronic fund transfer was made shall be admissible as evidence of such transfer and shall constitute prima facie proof that such transfer was made.
    The initiation by you of certain electronic funds transfers from your account will, except as otherwise provided in these Terms and Conditions, effectively eliminate your ability to stop payment of the transfer.
    UNLESS OTHERWISE PROVIDED IN THESE TERMS AND CONDITIONS, YOU MAY NOT STOP PAYMENT OF ELECTRONIC FUND TRANSFERS; THEREFORE, YOU SHOULD NOT EMPLOY ELECTRONIC ACCESS FOR PAYMENTS UNLESS YOU ARE SATISFIED THAT YOU WILL NOT NEED TO STOP PAYMENT.
    DISCLOSURE OF ACCOUNT INFORMATION TO THIRD PARTIES: If you give Agency or CIRQUL your authorization to disclose information about you, your account or the transactions that you make to any person, that authorization shall be effective until Agency or CIRQUL receive written notification from you to cancel such authorization, unless otherwise agreed or permitted by law.

Changes to These Terms and Conditions

Agency may change these Terms and Conditions. If any change is found to be invalid, void, or for any reason unenforceable, that change is severable and does not affect the validity and enforceability of any other changes or the remainder of these Terms and Conditions. Agency reserves the right to subcontract any of our rights or obligations under these Terms and Conditions.
YOUR CONTINUED USE OF YOUR PAYMENT METHOD SUBSCRIPTION PAYMENTS AFTER WE CHANGE THESE TERMS AND CONDITIONS CONSTITUTES YOUR ACCEPTANCE OF ALL CHANGES.

Consent to Electronic Communication

You should print and retain a copy of all communications. You agree to accept all disclosures and other communications between you, Agency and/or CIRQUL, or at the primary e-mail address associated with your CIRQUL Account, or via SMS Text. By indicating your acceptance to these Terms and Conditions in any way, including by clicking a button, checking a box, or registering your CIRQUL Account, you also are consenting to receive electronic communications from CIRQUL via the e-mail address you have provided and via SMS text. In order to receive electronic communications, you must have access to a personal computer with a 128-bit javascript-enabled browser, internet access, a valid email account supported by software that enables you to receive electronic communications, and an electronic device that allows you to receive SMS text messages.  Messaging rates/charges may apply depending on your mobile service account.  You agree that any messaging rates will be borne exclusively by you.  In order to store electronic communications, you will need a printer connected to your computer, or other device, to enable you to print such communications for storage in your off-line files, or a hard drive or a disk drive or cloud storage to download the electronic communications for storage. Neither Agency nor CIRQUL will provide paper copies of the electronic communications.
